American Poolplayers Association, Inc. and the Canadian Pool League, Inc. d/b/a Canadian Poolplayers Association (Collectively referred to as, “APA”, “us”, “our”, or “we”) knows that our users (“you”, “your”) care about how your personal information is used and shared, and we take your privacy seriously. This Privacy Policy explains how information about you is collected, used and disclosed by APA when you purchase, download, install, register with, access or use our websites, mobile applications and other online products and services. Our Privacy Policy remains the same whether you (A) visit the poolplayers.com website and subdomains or apaleagues.com website and subdomains (“Website”), (B) download an APA mobile application, including, without limitation, the APA Pool League and APA Scorekeeper apps (collectively referred to as “Apps”), (C) join our marketing campaigns and promotions, (D) fill out any survey or questionnaire. Together, the Website, Apps, marketing campaigns and promotions, and the services and products provided through each are referred to as the “Services”, (E) or interact or use any service or app provided by APA. Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By using our Services, you acknowledge that you accept and agree to the practices and policies outlined in this Privacy Policy.
Please note that this Privacy Policy does not apply to third party websites (“Third Party Services”), including without limitation Facebook, X, Instagram, and YouTube, which we do not own or control, even if you access them through our Services. While we operate this Website and Services, we are not responsible for the operation of each local APA League. Instead, each local APA League is owned and operated by independent franchisees (“Franchisees”). Each Franchisee is solely and independently responsible for its legal and regulatory compliance, for any issues relating to the sale of products or services to you, and for any employment related matters pertaining to the local APA League. If a Franchisee communicates with you by SMS or text message, that Franchisee is solely responsible for its own SMS/text messaging practices and policies, including any required notices, consents, opt-out mechanisms, and legal compliance. To the extent APA shares personal information with a Franchisee so the Franchisee can administer local league operations (for example, membership administration, league scheduling, or scorekeeping), the Franchisee may process that information under its own privacy practices. Where a request relates to personal information processed by a Franchisee, APA may direct you to the applicable Franchisee and/or, where appropriate, assist in routing the request.
What Information Do We Collect?
The information we collect from you falls into two categories: personally identifiable information (“Personal Information”) and non-personally identifiable information (“Non-Personal Information”). The Privacy Policy covers both types and tells you how we might collect, store, process, disclose, share and/or use each.

Information We Collect Directly From You.
- If you contact us by phone, email, live chat, Contact Us form, social media, or by some other means (either through our Services or through Third Party Services), we may keep a record of your contact information and correspondence for later reference to help improve our Services to you.
- Information you provide by filling out forms or registering an account on our Website, Apps, and/or other Services. This includes information provided at the time of registering to use our Website, Apps, and/or other Services, subscribing to or ordering any Services, posting material and/or user contributions, or requesting further services or assistance.

- When we send you emails, we may track whether you open them, so we can determine the best ways to pique your interest.
Information We Collect Automatically
Whenever you interact with our Website, Apps, and/or other Services we may automatically receive and record information on our server logs from your browser including your IP address, “cookie” information, usage and log information, and the page you requested.
- Cookies. “Cookies” are identifiers we store on your local browser or hard drive of your computer or mobile device that allow us to recognize your browser and tell us how and when pages in our site are visited and by how many people. You may be able to change the preferences on your browser to prevent or limit your computer or other device’s acceptance of cookies, but you may be unable to access and/or use certain parts or features of our Website, Apps, and/or other Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.

Certain features of our Website, Apps, and/or other Services may use cookies stored outside of your browser (or Flash cookies) that may be accessed by multiple browsers on the same computer to collect and store information about your preferences and navigation to, from and on our Website, Apps, and/or other Services. Flash cookies are not managed by the same browser settings as are used for browser cookies. - Other technologies such as “log files,” “pixel tags” or “web beacons”. When you access our Website, Apps, and/or other Services, our servers automatically record information sent from your browser, which may include your web request, Internet Protocol address, domain names, referring Uniform Resource Locator, browser type, browser language, and operating system; the date and time of your request and access; and Cookies that may uniquely identify your browser (collectively, “Usage Data”). We may combine Usage Data with Personal Information in a manner that enables us to trace Usage Data to an individual user, and may collect, use, preserve and disclose Usage Data in any manner that we may collect, use, preserve and disclose Personal Information as provided herein (whether Usage Data is combined with any Personal Information or otherwise). In addition, pages of our Website, Apps, our e-mails, and/or other Services may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other related Website statistics (for example, recording the popularity of certain Website content and verifying system and server integrity).
Third Party Use of Cookies and Tracking Technologies.
Third Party Services whose links are located on our Website may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. We do not control these Third Party Service tracking technologies or how they may be used. This Privacy Policy does not cover the use of cookies by any Third Party Services. Why Do We Collect Information and How Do We Use the Information We Collect?
We use information that we collect from and/or about you, including Personal Information, to perform Services for you, to pursue our legitimate interests, and for other purposes, including:
- To provide our Services and content to you and allow you to review our Services, create an account or profile or register for Services on the Website and/or Apps.
- To provide you with customer support and communication, and notices about your account, which may include expiration and renewal notices.
- We may also use Personal Information to communicate with you about new offers, features, products or services or to improve the services that we offer.
- To send you marketing information, service recommendations and other non-transactional communications about us, our affiliates, partners, and sponsors including information about our Services, promotions or events as necessary for our legitimate interest in conducting direct marketing or to the extent you have provided your prior consent, including without limitation, through requests made by you or use of built-in convenience features of the Services we provide to you.
- To conduct marketing research, advertise to you, provide personalized information about us on and off our Website and to provide other personalized content based upon the Services we provide to you to the extent it is necessary for our legitimate interest in advertising our Services or, where necessary, to the extent you have provided your prior consent, including without limitation, through requests made by you or use of built-in convenience features of the Services we provide to you.
- For analytical purposes, which may include generate and analyze statistics about your use of the Services for operational and/or security purposes, measurement of effectiveness of our marketing activities, performance improvements, research, testing and other business purposes.
- To promote the security of our Website, Apps, and/or other Services by verifying accounts and activity, investigating suspicious activities and enforcing our Membership Terms and Conditions, APA Terms of Use Agreement, and Intellectual Property Policies to the extent necessary for our legitimate interests in promoting the safety and security of the systems and applications used by our Services and to protect our rights and the rights of others.
- To develop and improve our Services.
- To cooperate with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent this requires the processing or disclosure of Personal Information to protect our rights or is necessary for our legitimate interest in protecting against misuse or abuse of our Services, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes or to respond to lawful requests.
- When you make a purchase or renew your membership you are directed to a Third Party Service website to enter your payment information (credit card number, expiration date, and CVV code) it is sent directly to a separate unrelated credit or debit card processing center which has represented to us that is PCI compliant. We neither take possession nor retain any of your credit or debit card account information.
- In any other way we may describe when you provide the information.
- For any other purpose with your consent.
How Do We Share Your Information?
We may disclose Personal Information that we collect or you provide through our Services as described in this Privacy Policy as follows:
- To third parties for the purpose for which you provide it.
- To Franchisees. We will forward or provide access to your Personal Information to Franchisees only to the extent that it is related to the Services. We have no control over the policies and practices of third party businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated business, please review all such businesses’ policies.
- To third-party companies and contractors that perform services on our behalf, including companies that provide website development, hosting, payment processing and billing services;
- To our affiliates, partners, and sponsors to send you marketing information, service recommendations, promotions, and event and contest information;
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of all or any portion of APA assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by APA about our Website, App, and Services users is among the assets transferred;
- To comply with any court order, law or legal process, including to respond to any government or regulatory request. We may disclose your personal information when we believe disclosure is appropriate to comply with the law or respond to a court order or subpoena; to prevent or investigate a possible crime, such as fraud or identity theft; or to protect the rights, property or safety of ourselves or others. We reserve the right to report to appropriate law enforcement, governmental authorities and other third parties any activities that we, in good faith, believe to be harmful or unlawful, with or without providing notice to you;
- To enforce or apply our Membership Terms and Conditions, APA Terms of Use Agreement, Intellectual Property Policy, and any other stated policy; or
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of APA, our members or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
We may anonymize Personal Information so that it is not identifiable to you, aggregate that information and share that information with third parties. We will not otherwise distribute, sell, rent, transfer, or otherwise disclose your Personal Information, to any third party, except as provided for in this Privacy Policy or with your consent.
Non-Personal Information.
We may share Non-Personal Information collected on our Services with service providers we do business with in order to better our Services. Additionally, we may combine aggregate information such as pixel tags, web beacons, or cookies as discussed above with similar data we collect from other visitors to help us improve our Services, provided that such aggregated data is anonymous and cannot be linked back to any individual. We may also disclose such aggregated, anonymized information and data that does not identify you or any other individual, without restriction.
Your Rights Under the California Consumer Privacy Act (“CCPA”)/CPRA
If you are a consumer who is a California resident, in addition to our general Privacy Policy, we would like to bring the following to your attention:

- Internet or other electronic network activity information, including, but not limited to, browsing history within our Website, search history within our Website, and information regarding your interaction with the Website, application, or advertisements located on the Website or applications
Your Rights as a California Resident. The CCPA may provide you the right to:
- Right to Access/Request. Upon a verifiable request, you are entitled, once a year, free of charge, to receive a copy of the Personal Information we collect about you, which may be delivered by mail or electronically. In addition, you are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of Personal Information to third parties for their direct marketing purposes in the preceding calendar year. California residents who have profiles on our Services and are under the age of 18 are entitled, in accordance with California law, to request and obtain removal of content and information that they themselves provide to our Services.
- Right to Correct or Rectify. Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate Personal Information we hold about you corrected, although we may need to verify the accuracy of the new data you provide to us.
- Right to Erase/Delete. Request erasure/deletion/removal of your Personal Information. This enables you to ask us to delete or remove your Personal Information where we do not have a valid reason to continue to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local law. Please Note: we are not required to comply with your request for erasure to the extent APA requires your Personal Information to: (1) complete the transaction for which the Personal Information was collected, provide a good or service requested by you, or reasonably anticipated within the context of APA’s ongoing business relationship with you, or otherwise perform a contract between APA and you; (2) detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; (3) exercise free speech, ensure the right of another consumer to exercise his/her right of free speech, or exercise another right provided for by law; (4) comply with the California Electronic Communications Privacy Act; (5) enable solely internal uses that are reasonably aligned with your expectations, based on the your relationship with APA, such as use your name in connection with your APA handicap; (6) comply with a legal obligation; (7) otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information. Additional note: complete removal of content and information may result in termination of your membership as we will be unable to provide the Services.
- Right to Opt Out. APA does not sell or share your Personal Information to or with third parties except as provided herein. However, in the event APA changes that policy, you have the right to object to sale or sharing of your Personal Information to a third party and we are prohibited from discriminating against you for exercising this right. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
- Right to Notification of Financial Incentives. A business may charge a consumer a different price or rate, or a different level or quality of goods or services to the consumer, if that difference is reasonably related to the value provided to the consumer by the consumer’s data. Businesses may offer financial incentives, including payments to consumers as compensation, for the collection of information, the sale of personal information, or the deletion of information. A business may also offer a different price, rate, level, or quality of goods or services to the consumer if that price or difference is directly related to the value provided to the consumer by the consumer’s data. We do not offer financial incentives for the collection of your personal information. APA will notify you if it offers any such financial incentives.
- Right Not to Be Discriminated Against. APA is prohibited from discriminating against you for exercising any of the your rights hereunder, including by: (A) denying goods or services to you; (B) charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties; (C) providing a different level or quality of goods or services to the consumer; or (D) suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services. The prohibition on discrimination, however, does not prohibit APA from charging you a different price or rate, or from denying a particular good or service, or providing a different level or quality of goods or services to you, if that difference is reasonably related to the value provided to you by your personal information, or if your personal information is required in order to provide the particular good or service. Except with respect to the exercise of your rights under the CCPA, nothing in the foregoing is intended to limit APA’s ability to suspend or terminate your membership in our association pursuant to APA’s standards, or to limit a League Operator’s right to refuse to do business with any Member, to the fullest extent permitted by applicable law.
To exercise your rights under the CCPA, please contact us by using the information in the “How Do I Opt Out?” or “Contact Information” sections, below. We try to respond to all legitimate requests within 45 days and will contact you if we need additional information from you in order to honor your request.
Some registered users may update their user settings, profiles, organization settings and event registrations by logging into their accounts and editing their settings or profiles.
Additional State Rights:
Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Nevada, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:
- Confirm whether we process their personal information.
- Access and delete certain personal information.
- Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
- Data portability.
- Opt-out of personal data processing for:
- targeted advertising (excluding Iowa);
- sales; or
- profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
- Either limit (opt-out of) or require consent to process sensitive personal data.
The exact scope of these rights may vary by state. To exercise these rights, you may contact us or opt out as provided below. However, please know we do not currently sell data triggering these statute’s opt-out requirements.
YOUR RIGHTS IN CANADA
If you are located in Canada (or otherwise interact with the Services from Canada), you may have rights and protections under applicable Canadian privacy laws, including federal and provincial private-sector privacy laws. These laws generally require organizations to be transparent about their personal information handling practices and to provide individuals with access to, and the ability to correct, their personal information, subject to certain exceptions.
- Accountability / Contact for Privacy Questions: APA is responsible for Personal Information under its control and has designated a person responsible for privacy compliance (a “Privacy Officer”). You may contact our Privacy Officer using the Contact Information section of this Privacy Policy.
- Access and Correction: You may request access to the Personal Information APA maintains about you and request correction of inaccuracies, subject to applicable legal limitations. APA will respond in accordance with applicable Canadian law.
- Withdrawal of Consent: Where APA relies on your consent to collect, use, or disclose Personal Information, you may withdraw that consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may affect APA’s ability to provide certain Services.
- Cross-Border Processing: APA and its service providers may process, store, or access Personal Information in the United States, Canada, or other jurisdictions. In those cases, Personal Information may be subject to the laws of the jurisdiction(s) where it is processed.
- Complaints: If you have questions or complaints about APA’s privacy practices, you may contact us using the Contact Information section of this Privacy Policy. You may also have the right to raise concerns with a Canadian privacy regulator (for example, the Office of the Privacy Commissioner of Canada or applicable provincial privacy regulators), depending on your circumstances and location.
- Security Breach Notification (Canada): Where required by applicable Canadian law, APA will provide notice to affected individuals and/or regulators regarding certain breaches of security safeguards involving Personal Information under APA’s control.
- Quebec (Law 25) – Additional Notice: If you are a resident of Quebec, additional requirements may apply to APA’s processing of your Personal Information, including enhanced transparency and governance obligations and specific rules regarding cross-border transfers of Personal Information, as applicable.
How Do I Opt Out?
When you use our Services, we work to provide you the ability to access, review, correct, edit, or remove your Personal Information and related content that you have provided to us. If you have created an account, you can do this by logging into the Services and visiting your account profile page. Please include your name and any other identifiable information necessary, so that we may locate your information. Under certain privacy laws you may have a right to access your Personal Information that we hold about you, however, your rights to access your Personal Information are not absolute. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical. In addition, we may not accommodate a request to access or change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. If we deny your request for access to, or refuse a request to correct Personal Information, we shall explain why. For your information, removal of your Personal Information may impact our ability to provide you or your ability to use our Services.

If you have created an account, you can do this by logging into the Services and visiting your account profile page. Please include your name and any other identifiable information necessary, so that we might locate your information. If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions. This opt out does not apply to information provided to the APA as a result of a product purchase or rentals, product service experience or other customer related transactions.
How Long Do We Retain Your Personal Information?
We retain your Personal Information and information stored and collected through our Services for as long as we have a business or tax need or as applicable laws, regulations, or government orders require. When your information is no longer necessary or relevant for the identified purpose or to fulfill a legal or business requirement, we will use reasonable commercial efforts to securely dispose of and destroy your information collected through the Services.
After expiry of the applicable retention periods, your Personal Information will be deleted. If there is any information that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use or disclosure of such Information.
Is My Information Secure?
We take your privacy seriously. Therefore we take several security measures to help keep your Personal Information safe including procedural and technological measures. However, there is no perfect security that is impenetrable from hackers. Therefore, we cannot guarantee the absolute security of the information that we collect. In the event of such a security breach involving Personal Information, APA will, in compliance with any applicable federal, state, and foreign data breach laws, endeavor to timely notify all users whose Personal Information APA knows or has clear reason to believe was accessed by an unauthorized person.
The safety and security of your Personal Information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone and you agree not to provide any other person with access to the Services or portions of it using your name, password or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. We have the right to disable any user name, password or identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including, if, in our opinion, you have violated any provision of this Privacy Policy.
SMS TERMS AND CONDITIONS
- Program Description. APA and its service providers may use an automatic telephone dialing system or software platform (“autodialer”) to deliver APA text messages to you. APA text messages are intended to provide you with information about our services, registration, events, and promotions.
- Message Frequency. You will receive messages periodically in conjunction with our services, registration, events, and promotions.
- Cost. Message and data rates may apply to each text message sent or received in connection with APA text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. APA does not impose a separate fee for sending APA text messages.
- Supported Carriers. Supported carriers may change from time to time.
- How to Opt-Out. To stop receiving text messages from the APA text messaging program, reply with “STOP” for the text messaging program from which you no longer wish to receive message. You will then receive confirmation of your opt-out of the text messaging program. If the APA has more than one text messaging program which you have opted-in, this will only opt you out of the specific text messaging program associated. You will remain opted in to other APA text messaging programs.
- Your Mobile Telephone Number. You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying APA immediately if you change your mobile telephone number. You may notify APA of a number change by contacting us as provided below. You agree to indemnify APA in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify APA if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
- Access or Delivery to Mobile Network is not Guaranteed. Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of APA’s control, and APA is not responsible or liable for issues arising from them.
- Eligibility. To receive APA text messages, you must be a resident of the United States and 18 years of age or older. APA reserves the right to require you to prove that you are at least 18 years of age.
- Changes to Terms and Conditions. APA may revise, modify, or amend these SMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to APA’s website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive APA text messages will indicate your acceptance of those changes.
- Termination of Text Messaging. APA may suspend or terminate your receipt of APA text messages if APA believes you are in breach of these SMS Terms and Conditions. Your receipt of APA text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. APA reserves the right to modify or discontinue, temporarily or permanently, all or any part of APA text messages, with or without notice.
Other Privacy Concerns.
Children’s Privacy. We are committed to protecting the privacy of children and encourage parents and guardians to take an active role in their children’s online activities and interests. Our Services are not directed to children or designed to attract them. You must be at least 18 years of age to use our Services. We do not knowingly collect, use, or disclose Personal Information about users that are under 18 years of age.
